Nineteen AI bills passed into law in two weeks. That sentence captures the speed at which American states have moved to regulate artificial intelligence — and it explains why the fight over federal preemption has become one of the most consequential policy battles of 2026.

On March 20, the White House released its National Policy Framework for Artificial Intelligence, a sweeping set of legislative recommendations intended to establish what the administration describes as “a coherent, nationally unified approach to AI governance.” The document covers seven areas — child safety, community and infrastructure impacts, intellectual property, free speech, innovation, workforce development, and, most controversially, the preemption of certain state AI laws.

The administration’s position is that fifty conflicting state regulatory regimes would create an unworkable patchwork for companies building and deploying AI across state lines. Better, the framework argues, to establish a single, minimally burdensome national standard that allows the American AI industry to compete with China and the European Union without drowning in compliance complexity.

Critics see it differently.

The GUARDRAILS Act: A Direct Counter

Within weeks of the White House framework’s release, Democratic members of Congress introduced the Guaranteeing and Upholding Americans’ Right to Decide Responsible AI Laws and Standards Act — the GUARDRAILS Act. The legislation would repeal the Trump administration’s executive order establishing a national AI policy framework and effectively block any congressional effort to impose a moratorium on state-level AI regulation.

The bill’s sponsors argue that states are the appropriate laboratory for AI governance experiments. California’s AI regulations, New York’s algorithmic discrimination rules, and Texas’s deepfake laws have developed through democratic processes that reflect the specific concerns of those states’ residents. Preempting all of that with a single federal standard — one that critics note would likely be weaker than what many states have already enacted — would strip citizens of meaningful protection.

“This isn’t about AI innovation,” said one Democratic co-sponsor of the GUARDRAILS Act during a floor debate last month. “This is about giving the industry a federal shield against accountability.”

The industry’s position is more nuanced. Large technology companies, in their public statements, have expressed support for a “consistent national framework” — language that carefully avoids endorsing preemption while signaling that they prefer lighter-touch federal rules to the patchwork of state requirements. Smaller AI developers, who often lack the compliance infrastructure of the big players, have been more direct in their support for preemption.

The State Lawmaking Explosion

The urgency of the preemption debate is driven by numbers. According to tracking by Plural Policy, 25 AI laws have been enacted across the United States in the first four months of 2026 — a record pace that shows no signs of slowing.

The most concentrated burst came in late March, when 19 new AI laws passed into effect over a roughly two-week period. The laws ranged from requirements for AI-generated content disclosure to restrictions on autonomous weapons systems to consumer protection rules for AI-powered financial products.

The diversity of state approaches reflects both the breadth of AI’s societal impact and the fragmentation of regulatory philosophy. Texas has focused on combating AI-generated deepfakes used for non-consensual intimate images and election interference. Illinois has extended its Biometric Information Privacy Act to cover biometric data used in AI training. Colorado has enacted rules requiring algorithmic impact assessments for high-stakes AI decisions in employment, housing, and credit.

For companies operating nationally — a category that includes most significant AI developers and deployers — each new state law adds another compliance layer. Legal teams at major tech companies have expanded dramatically; some report that AI regulatory compliance now consumes as much internal resource as GDPR preparation did in 2018.

New York and California: The Battleground States

Two states have become focal points of the preemption debate, partly because of the scale of their AI industries and partly because of the sophistication of their regulatory approaches.

In New York, the RAISE Act — originally proposed as a broad AI safety framework modeled on California’s rejected SB 1047 — was amended by Governor Kathy Hochul in late March. The revised law shifts from a prescriptive safety-requirement model to a transparency-and-reporting framework: large AI developers must disclose training data provenance, publish model evaluations, and notify regulators of significant capability upgrades, but they are not required to meet specific performance thresholds before deployment. The compromise reflects the political difficulty of applying frontier AI regulations to a state that hosts a growing AI research ecosystem.

California has taken a different tack. On March 30, Governor Gavin Newsom issued Executive Order N-5-26, directing state agencies to draft AI safety requirements for companies seeking state contracts. The order effectively establishes a procurement-based AI governance regime: companies that want to do business with California’s $1.1 trillion state economy must meet AI safety standards that Newsom’s administration will define. This approach bypasses the state legislature — where AI bills have repeatedly stalled — and creates direct market-based pressure on AI developers.

The federal preemption question would, if enacted, render significant portions of both the New York and California frameworks inoperative, at least for interstate AI applications.

The Innovation Argument and Its Limits

The Trump administration’s framework leans heavily on the innovation argument: a fragmented regulatory environment will cause AI companies to offshore development, chill investment, and cede technological leadership to China. The EU’s AI Act, which began enforcement in August 2024, is frequently cited as a cautionary tale — a comprehensive framework that, critics argue, has created compliance costs that disadvantage European AI companies relative to American and Chinese rivals.

There is some merit to this concern. The EU AI Act’s high-risk classification system has created genuine uncertainty for companies trying to determine whether their products qualify as high-risk under the regulation’s sometimes ambiguous categories. Some European AI startups have reported relocating to the UK or US specifically to avoid EU compliance requirements.

But AI governance experts note that the analogy has limits. The US and EU are at different points in AI regulatory maturity, and the choice is not binary between “no state regulation” and “everything the EU has done.” The GUARDRAILS Act, for example, would preserve state authority while leaving room for eventual federal standards developed through a more deliberative process.

What Comes Next

The GUARDRAILS Act faces an uncertain path in the current Congress. Republican leadership in both chambers has been broadly sympathetic to the preemption argument, but the legislation has not yet been introduced in a form that includes specific preemption language — meaning the actual regulatory text remains undefined, which makes it difficult to assess what the federal standard would look like in practice.

The more immediate battleground is the administrative and regulatory sphere. Several federal agencies — the FTC, EEOC, and Consumer Financial Protection Bureau — have been active in applying existing law to AI systems, creating a de facto federal AI regulatory presence even in the absence of comprehensive legislation. How those agencies interpret their existing authorities, and whether the White House framework constrains or directs their enforcement priorities, will determine how much practical impact the preemption debate has in the near term.

For businesses, the answer for now is to comply with everything. A company deploying AI in employment decisions faces federal civil rights law, state algorithmic discrimination rules in at least a dozen jurisdictions, and sector-specific guidance from federal regulators. The cost of that complexity is real — and so is the cost of the harm that motivated all those state laws in the first place.

The preemption debate is ultimately a proxy for a harder question: who is responsible for ensuring that AI systems are safe and fair? The answer that emerges from Washington this year will shape American AI governance for a decade.
