The session — open to industry representatives, civil society groups, and technology contractors — focused on a proposed clause known as GSAR 552.239-7001, formally titled “Basic Safeguarding of Data Within Large Language Model Artificial Intelligence Systems.” When finalized, it will govern how every federal agency contracts for AI systems that involve large language models.

Written comments are due August 3, 2026. Legal experts who have reviewed the draft clause say that when finalized, it will define federal AI procurement for the next decade.

What the Rule Requires

The proposed clause is broad in scope and specific in technical requirements, and it will force significant changes across the federal contractor ecosystem.

Its scope is defined by data: the clause applies to any federal contract in which government information will be processed by a large language model, regardless of whether that model is provided directly by the prime contractor or embedded several layers down in a subcontractor’s technology stack. That scope triggers the rule’s most important structural requirement — full supply chain flowdown. Every obligation created by GSAR 552.239-7001 must cascade through every developer, operator, integrator, and service provider in the delivery chain.

The substantive requirements cluster around several core principles.

Government data ownership and “eyes off” handling is the centerpiece. Under the rule, federal data processed by an LLM cannot be used by the contractor for any purpose beyond fulfilling the specific contract — no model training, no improvement, no benchmarking. This “eyes off” standard is significantly stricter than what most commercial AI contracts currently impose and would require major structural changes to how foundation model providers package their government offerings. Models that train on user inputs — even for performance improvement — would not be compliant without explicit structural separation between commercial and government data flows.

U.S. jurisdictional controls require that LLM systems processing federal data operate under American legal authority and remain subject to GSA oversight. This provision functions as a practical barrier against routing government data through models hosted on infrastructure based in non-allied jurisdictions, or through models trained primarily on such infrastructure. The provision reflects persistent concerns within the intelligence community about data exposure via foreign AI cloud providers.

Incident reporting requirements are modeled on the existing federal cybersecurity incident disclosure framework, requiring contractors to notify GSA within defined windows when an LLM system behaves anomalously, generates unexpected outputs, or is subject to external interference or prompt injection attacks.

The “Unbiased AI Principles” framework is the most novel element. It imposes affirmative obligations on contractors to prevent LLM systems from producing outputs that systematically favor or disfavor groups in ways inconsistent with federal equal opportunity standards. Crucially, violations of this requirement can trigger termination-for-cause provisions — a meaningful liability lever that goes well beyond the voluntary commitments that AI companies have made to date. No other federal AI procurement standard currently carries termination-for-cause exposure for discriminatory outputs.

The rule also explicitly permits open-source AI components under a risk-based security evaluation framework, replacing earlier draft language that had imposed blanket restrictions on open-source models due to difficulties in verifying their provenance and modification history. The revised approach requires open-source components to pass a security assessment rather than banning them categorically — a significant concession to industry pressure.

Industry Reception

The listening session today is the second public engagement since GSA reissued updated draft regulations on June 17. The first round of sessions generated a complex mix of responses.

Large system integrators — Booz Allen Hamilton, Leidos, SAIC, and others that depend heavily on federal AI contracts — broadly praised the rule’s shift toward risk-based frameworks. “We can work with a risk framework,” one senior contractor representative told Federal News Network. “We cannot work with a world where agencies can’t use any open-source model regardless of its actual security characteristics.”

But significant concerns remain about the supply chain flowdown requirement, which critics describe as technically unworkable for many existing contract structures. A prime contractor’s AI platform may incorporate components from a dozen different model providers, each of which maintains its own data handling infrastructure. Requiring every node in that chain to independently comply with GSAR 552.239-7001 would necessitate either comprehensive renegotiation of existing subcontractor agreements or significant consolidation of the vendor base — neither of which happens quickly or cheaply.

Foundation model providers face a specific structural challenge. Companies like Anthropic, OpenAI, Google DeepMind, and Microsoft already operate FedRAMP-authorized government cloud environments, but the data-use restrictions in GSAR 552.239-7001 go further than FedRAMP requirements. Compliance would require complete separation between commercial model improvement pipelines and government-contract data flows — a non-trivial engineering and legal separation.

Civil society organizations have focused their comments on enforcement. The Unbiased AI Principles framework is welcome, several groups have told GSA, but without an independent auditing mechanism and clear procedures for investigating alleged violations, it risks becoming procedurally toothless. “The liability is there on paper,” one technology policy advocate noted. “The question is whether there’s a process that would actually trigger it.”

What Is at Stake

The federal government is among the largest software and technology buyers in the world. A rule governing how agencies procure AI will ripple through every company that sells to the government — and through the technology supply chains those companies depend on. Legal experts estimate that, at full implementation, GSAR 552.239-7001 would cover contracts worth hundreds of billions of dollars annually.

The rule also has competitive implications at the model layer. Its U.S. jurisdictional controls and “eyes off” requirements effectively raise barriers for foreign AI providers — including any Chinese model provider — from accessing federal contracting opportunities. This was almost certainly intentional: the policy environment around AI procurement has been shaped as much by national security concerns about data exposure as by technical considerations about model quality.

For the broader AI industry, the rule’s most significant long-term effect may be to entrench a structural divide between commercial and government AI product lines. Companies that can sustain dual technology stacks — one optimized for commercial deployment, one engineered for federal compliance — will have an inherent advantage over smaller competitors that cannot absorb that operational overhead.

Context

GSAR 552.239-7001 fits into a broader pattern of regulatory activity. The FTC is simultaneously seeking public comment on a proposed policy addressing AI output accuracy and manipulation. Illinois signed landmark AI audit legislation earlier this month. The White House released a National AI Framework in March. State legislatures across the country have been advancing AI bills at a pace that outstrips the federal government’s ability to establish a single coherent national standard.

What distinguishes the GSA rule is its procurement mechanism. Unlike legislation, voluntary frameworks, or enforcement policy, a procurement clause is self-executing: once finalized, it immediately attaches to new federal contracts without requiring additional regulatory action. It is, arguably, the most direct lever the federal government has to shape the behavior of AI companies without passing a law.

The public comment period closes August 3. The rule is expected to be finalized before the end of the federal fiscal year on September 30 — which would make it effective for government AI contracts beginning in fiscal year 2027.
