EU Targets Meta's WhatsApp and Mandates AI Content Labels in Twin Regulatory Blitz
European regulators issued two significant AI-related decisions on June 10: ordering Meta to restore WhatsApp API access for competing AI chatbot developers under an antitrust investigation, and publishing the operational Code of Practice for labeling AI-generated content under the EU AI Act. Together the decisions redefine how messaging platforms and synthetic media are governed across the bloc.
The European Union served notice on June 10 that its regulatory approach to AI extends well beyond the headline provisions of the AI Act. In a single day, Brussels produced two consequential decisions — one under competition law, one under the AI Act’s content governance framework — that together sketch a vision of AI regulation that reaches into messaging platforms, content distribution, and synthetic media disclosure simultaneously.
The WhatsApp Order: AI Distribution as Monopoly Infrastructure
The more immediately confrontational of the two decisions is an order requiring Meta to restore API access to WhatsApp for third-party AI chatbot developers. The order was issued by the European Commission under its ongoing investigation into whether Meta has used WhatsApp as exclusive distribution infrastructure for its own AI assistant — a potential violation of the Digital Markets Act’s interoperability requirements.
The facts underlying the investigation are not complicated. WhatsApp has 2.1 billion active users globally, with particularly high penetration in Europe, Latin America, and South Asia. Since late 2024, Meta has integrated its own AI assistant directly into WhatsApp conversations, accessible via a dedicated button in the chat interface. At the same time, Meta has restricted API access that would allow competing AI services — from Anthropic, Google, or third-party chatbot developers — to be delivered within WhatsApp conversations in a comparable way.
The Commission’s position is that WhatsApp’s messaging infrastructure constitutes a “core platform service” under the DMA, and that Meta’s differential treatment of its own AI versus competitors’ AI on that infrastructure is precisely the kind of self-preferencing the legislation was designed to prohibit. The interim order — which takes effect immediately pending the full investigation — requires Meta to restore the API access conditions that prevailed before the integration of Meta AI into WhatsApp.
Meta has 60 days to comply or face daily fines of up to 5 percent of daily global revenue, a figure that would translate to approximately $1.7 billion per day based on the company’s 2025 financials. Meta has not yet issued a formal response, but the company is widely expected to challenge the order in court while initiating technical compliance measures.
Why This Sets a Precedent
The WhatsApp decision introduces a new theory of harm that regulators have been slow to articulate: that consumer messaging applications are AI distribution infrastructure, and that controlling such infrastructure to advantage one’s own AI products constitutes an antitrust violation independent of traditional market-share analysis.
This framing, if it holds on appeal, has implications that extend well beyond Meta. Apple’s iMessage — which has similarly resisted interoperability while integrating Apple Intelligence features — faces an analogous challenge from a different regulatory angle. Telegram, which has been more open to third-party integrations, is better positioned, but even its operator API structure could come under scrutiny as AI integration deepens.
In the United States, where antitrust regulators have been slower to develop an AI-specific enforcement theory, the EU WhatsApp order is likely to attract significant attention from the FTC and DOJ Antitrust Division. European antitrust decisions frequently anticipate US enforcement actions by 18 to 24 months; the self-preferencing theory that underpinned the Google Shopping and Android cases in Europe eventually informed US complaints against Google Search.
The AI Content Labeling Code: From Guidance to Obligations
The second decision — the publication of the EU AI Act’s Code of Practice for AI-generated content labeling — is less confrontational but potentially more structurally significant for the technology industry.
The Code translates the AI Act’s requirement to “clearly label” AI-generated content from abstract obligation into operational compliance standard. It specifies:
Disclosure format: AI-generated images, video, audio, and text must be labeled with a standardized visual indicator (a small “AI” badge or equivalent) visible at the point of consumption, not merely in metadata or terms of service. The badge must appear for at least three seconds before any content interaction is permitted.
Watermarking requirements: For video and image content, platforms must implement C2PA-compatible cryptographic watermarking in addition to visible labeling, maintaining an auditable chain of provenance from generation through distribution.
Scope: The obligations apply to general-purpose AI models used to generate content (covering OpenAI, Google, Anthropic, Meta, and others), as well as to platforms that host or distribute AI-generated content (covering YouTube, Instagram, TikTok, X, and similar services).
Enforcement timeline: Compliance is required by August 2, 2026 — the same date on which the AI Act’s general-purpose AI provisions formally enter enforcement. Companies that miss the deadline face fines of up to 3 percent of global annual revenue.
The Compliance Challenge
The Code of Practice creates a substantial technical compliance burden in a compressed timeframe. The C2PA watermarking standard, while technically sound, requires implementation at the model inference layer — meaning every major AI content generation platform must update its generation pipeline to embed provenance data before output is delivered to users.
For the largest players — OpenAI, Google, Adobe — this is an engineering challenge they have been anticipating and working on since the AI Act was finalized in 2024. Adobe’s Content Credentials system is already C2PA-compatible. OpenAI has been working with the C2PA steering committee since early 2025.
For smaller platforms and open-source model operators, the requirements are more onerous. The Code does not provide an exemption for open-weight models that are subsequently fine-tuned or deployed by third parties, which creates a compliance gap that legal experts expect will require interpretive guidance before August.
The visible labeling requirement also raises user experience questions that the Code does not fully resolve. A three-second mandatory badge delay before content interaction may be technically straightforward to implement but commercially disruptive for platforms where AI-generated content makes up a significant percentage of total engagement — a category that now includes most major social platforms.
A Day That Defines the Regulatory Terrain
Taken together, the two decisions mark a significant maturation of the EU’s AI regulatory posture. The AI Act, passed with considerable fanfare in 2024, has sometimes been criticized as more aspirational than operational — a framework with ambitious goals but vague implementation details. The WhatsApp antitrust order and the content labeling Code represent the first moment at which both competition law and sector regulation are being applied to AI with the specificity and urgency that enforcement requires.
For companies operating globally, June 10 is the date on which EU AI compliance ceased to be primarily a legal project and became an engineering one.
