In the absence of a national framework, the states have stepped into the void — and the resulting regulatory landscape is increasingly complex, inconsistent, and consequential for any company deploying AI products to American consumers.

Nebraska’s passage of LB 1185 — which adopts the Conversational Artificial Intelligence Safety Act — is the week’s most concrete development, but it is part of a broader surge in state-level AI legislation that shows no signs of slowing.

Nebraska’s Conversational AI Safety Act: What It Requires

Sponsored by State Senator Eliot Bostar of Lincoln, Nebraska’s Conversational Artificial Intelligence Safety Act is the most detailed state-level attempt yet to regulate AI chatbot behavior specifically for consumer-facing and minor-user contexts.

Disclosure requirements sit at the core of the bill. Any operator of a conversational AI service must clearly disclose, at the beginning of each interaction, that the user is speaking with an AI — not a human. The threshold is intent and perception: if a reasonable person would be misled into thinking they are interacting with a human, disclosure is required. This covers everything from customer service bots to AI companion applications.

Continuous session disclosures go further. In sessions lasting more than three hours, operators must re-disclose the AI’s non-human nature at three-hour intervals. The provision targets AI companion apps and mental health chatbots, which have come under scrutiny in multiple states following high-profile incidents of users developing parasocial dependencies on AI systems.

Minor-specific protections are extensive. Operators must take affirmative steps to ensure AI systems cannot produce sexually explicit content for users identified as minors, and must implement age-appropriate content filters across the interaction stack. This is not a content-labeling requirement — it is an operational obligation on the service itself.

Crisis response protocols are perhaps the most substantive provision. Any conversational AI system must implement a defined response protocol when users express suicidal ideation or intent to self-harm. At minimum, the protocol must direct users to crisis service providers — the National Suicide Prevention Lifeline, the Crisis Text Line, or other appropriate services. Operators cannot simply refuse to respond or pivot the conversation; they have an affirmative duty to provide crisis referrals.

Enforcement rests exclusively with the Nebraska Attorney General, who may bring civil actions and seek penalties between $1,000 and $500,000. Critically, there is no private right of action — individual users cannot sue. The law becomes operative on July 1, 2027, giving operators approximately 14 months to come into compliance.

Why Nebraska Matters Beyond Its Borders

Nebraska is not typically the state that shapes national technology policy. But the Conversational AI Safety Act is built on a framework — AI disclosure, crisis protocols, minor protections — that advocates have been pitching to legislatures across the country. Its passage in a Republican-controlled unicameral legislature signals that this framework has cross-partisan appeal, which makes it significantly more likely to be adopted elsewhere.

The bill’s crisis response protocol provision, in particular, is a direct legislative response to the high-profile deaths of teenagers whose AI companion chatbots reportedly encouraged or failed to discourage self-harm. Those cases have generated bipartisan momentum for chatbot regulation that has been difficult for industry to counter on purely economic grounds.

The National Patchwork and Its Costs

Nebraska joins Colorado, Texas, California, Illinois, and at least a dozen other states that have passed or are actively advancing AI-specific legislation in 2025-2026. The scope varies enormously — from Colorado’s comprehensive AI Act, which includes employment-related AI decision-making requirements, to narrower state bills targeting specific use cases like facial recognition, credit scoring, or healthcare AI.

According to Stanford HAI’s 2026 AI Index, released the same day as this tracker update, 47 countries globally now have active AI legislation. In the United States alone, compliance costs for AI systems vary by as much as 8x between different state regulatory regimes, creating a fragmented landscape that smaller AI companies in particular struggle to navigate.

For a company deploying a consumer-facing AI product nationally, the matrix of requirements already includes:

  • Disclosure mandates (timing, format, and frequency vary by state)
  • Prohibited use cases (differs between states for healthcare, employment, housing)
  • Minor protection obligations (overlapping with federal COPPA but often stricter)
  • Algorithmic impact assessment requirements (Colorado, California)
  • Data retention and deletion rules (varying from 30 to 90-plus days across states)

This is not a theoretical compliance burden. Legal teams at mid-size AI companies are increasingly dedicating significant resources to state-level monitoring and risk mapping that would have been unnecessary two years ago.

The Federal Stalemate

The state fragmentation is directly attributable to the collapse of federal AI legislation momentum. The Blueprint for an AI Bill of Rights, released in 2022, established principles but not law. Multiple Senate AI bills introduced between 2023 and 2025 failed to clear committee. The current Congress has not advanced comprehensive AI legislation past the committee stage, and there is no credible prediction of federal action before the 2026 midterms at the earliest.

Industry groups have consistently advocated for federal preemption — a national AI law that supersedes state regulation and creates a single compliance standard. Tech companies make the predictable argument that regulatory fragmentation stifles innovation and creates compliance costs that larger incumbents can absorb but startups cannot.

Both sides are correct in their own framing. The current situation is genuinely costly and genuinely serves a protective function. It is also the inevitable consequence of a federal government that cannot move at the pace of technology.
